Wet n wild is looking for females preferably 18 to 28 to simply submit your best Head Shot for your chance at joining their fun, seductive, and wild world. You and a runner-up will be showcased across the nation as the glamorous, fabulous faces of wet n wild!

    The winning models images will gain mass exposure and be used for the following:

    - pre-packs, displays and in-store materials

RULES FOR PARTICIPATING IN THE WET N WILD CREATIVE INVITE

Talenthouse, Inc. (Talenthouse) has partnered with WET N WILD COSMETICS (Host) to offer its members the opportunity to become models for the upcoming advertising and marketing campaign by winning the WET N WILD Creative Invite (Invite). The Invite asks Talenthouse members to illustrate their beauty, uniqueness, enthusiasm and creativity by creating and posting submissions to the Creative Invite. Like each Talenthouse member, the Invite, the Hosts prior work or ideas and Talenthouses community are all unique. We all want that uniqueness to be protected from unauthorized, harmful uses. Therefore, Talenthouse has created these rules.

In order to participate in the Invite, and/or to receive any compensation offered in the Invite, the Talenthouse member posting a submission in response to the Invite (Participant) must expressly and unequivocally agree to the following rules, terms and conditions:

1. Basic Participant Requirements

1.1. Participant must be 18 years of age or older at the time her or she submits his or her Entry to Talenthouse. Participant must have the legal capacity to agree to Talenthouses Terms of Use for the its web site as well as these Rules.

1.2. Participant must accept all of the terms and conditions in Talenthouses Terms of Use and, by participating in this Invite, Participant agrees to be bound by said Terms of Use in their entirety. The Terms of Use can be found at http://pages.talenthouse.de/terms_of_service.html. If any term or condition of Talenthouses Terms of Use conflict with these Rules, these Rules shall govern in such instance and the other terms and conditions of the Terms of Use shall remain in full force and effect.

2. Property Rights, Restrictions and Creative Invite Prize

2.1. The material submitted by Participant in response to the Invite, whatever form it may take (all such submitted materials shall be referred to as the Entry), cannot contain trademarks, logos owned by others, or otherwise infringe upon the intellectual property of any third party.

2.2. Participant understands, acknowledges and agrees that he or she shall take no ownership interest in any materials, provided in any medium, owned by the Host which materials are made available to Participant as part of the Invite process. Participant may only use the materials submitted by Host for or as part of the Invite for the sole purpose of creating and submitting an Entry. Talenthouse members who view the Invite and/or use the material submitted by Host, but who do not in turn submit an Entry, shall not use said materials in any way or in any medium whatsoever. If Participant uses Hosts property or material, which has been submitted for or as part of the Invite, in any way and/or in any medium, Participant my become liable to Host and/or Talenthouse (including attorneys fees and costs) under all causes of action related to the unauthorized use of the property or materials. In addition, Participant shall indemnify Host and/or Talenthouse to the fullest extent of the law (including attorneys fees and costs) for any claims arising from, relating to or referring to the unauthorized use of Hosts materials. Participants indemnity obligations shall in no way limit his or her liability to Host or Talenthouse for infringement of intellectual property or other claims for damages.

2.3. Host will choose the winner(s) in its sole discretion. Participant understands, acknowledges and agrees that Host is not required to choose a winner and is not bound by the results of voting. Subject to Paragraph 6.3, below, an Entry chosen as a winner of the Invite will be offered Hosts standard two year buy-out agreement. The buy-out agreement shall be negotiated directly between Host and the winning Participant(s) Talenthouse will not be involved in this process. Host will seek to negotiate the terms of the buy-out with the winning Participant or the Participants representative such that Participants images can be used on product packaging, on point of sale displays in stores and in promotional videos. The winning Participant(s) will also be paid Hosts standard daily rate for the day(s) of the required photo or video shoot. Talenthouse retains the right to use the Entry as set forth in the Terms of Use.

2.4. The Entry cannot contain copyrighted materials, materials which may be in any form, owned by others unless Participant has obtained the written permission of the copyright owner(s). Any such written permission must be submitted to Talenthouse at the same time as Participants Entry.

2.5. The Entry cannot contain materials embodying the names, likeness, photographs, or other indicia identifying any person, living or dead, without written permission.

3. Use of Entries

3.1. By submitting an Entry, Participant agrees that his or her Entry is gratuitous and made without restriction and will not place Host or Talenthouse under any obligation, and Host and Talenthouse are free to disclose any of the materials in the Entry on a non-confidential basis to anyone or to otherwise use the materials without any compensation to Participant. Participant acknowledges, by submission of his or her Entry, that Host and Talenthouse do not waive any rights to use similar or related materials or ideas, in any form whatsoever, previously known to Host or Talenthouse or developed by Host or Talenthouse, including their employees, contractors, or agents, independently or obtained from sources other than Participant.

3.2. By participating in the Invite, Participant agrees to have his or her name, voice, or likeness used in any advertising or broadcasting material relating to this Invite without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent as a condition to posting the Entry on Talenthouses web site.

4. No Obligation To Post Entry

Talenthouse reserves the right to, and may or may not, monitor and or screen a Participants Entry prior to posting it to Talenthouses web site. By submitting the Entry, Participant acknowledges that Talenthouse has no obligation to post his or her Entry on the site.

5. Originality of Entry

By submitting an Entry, Participant warrants and represents that it: (a) is Participants original work (except with respect to the Hosts property or materials which remain its sole and exclusive property); (b) has not been previously published in any medium or in any form; (c) has not won previous awards or contests; (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or intellectual property, proprietary property or other rights of any person or entity; (e) Participant has obtained permission for all persons whose name, likeness, image or voice is used in the Entry; and (f) the publication of the Entry via various media including internet/online posting, will not infringe on the rights of any third party. Participant shall indemnify Host and Talenthouse, to the fullest extent of the law (including reasonable attorneys fees and costs), for any claim referring or relating to the breach of these warranties.

6. Compensation, Awards, Indemnity and Taxes

6.1. Payments of all federal, state and local taxes are solely the responsibility of the Participant. Participant may be required to sign an IRS Form W-9 or the equivalent.

6.2. Prior to awarding any prize or prize certificate, Host and/or Talenthouse may require Invite winners (and their agents) to sign a liability release, agreeing to hold Host (including but not limited to his, her or its agents, representatives and employees) and/or Talenthouse (including, but not limited to, its corporate licensee, its subsidiary and affiliated corporations, and its officers, shareholders, directors, employees, agents and representatives) harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Invite.

6.3. In furtherance of Paragraph 2.3, above, the value of any prize or consideration received by any Participant from Talenthouse or Host for participation in the Creative Invite (including but not limited to the two year buy-out agreement between Host and Participant) shall not exceed $4,500 USD or $4,500 worth of non-cash consideration.

7. Voting and Determining Invite Winners

7.1. Each Participant may not vote for his or her own Entry or Entries. A Participant may vote one time for each of the other Participants Entries. Supporters (users of the Talenthouse site who are not themselves members) may vote for each Entry as many times as he or she desires.

7.2. The winner of each Invite is determined on an Invite-by-Invite basis. Winning criteria may or may not be posted within the Invite itself. Participant acknowledges, understands and agrees that he or she is not entitled to anything regardless of the number of votes his or her Entry receives.

8. General Rules

8.1. Talenthouse, in is sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Talenthouse website or is otherwise in violation of the Rules. Talenthouse further reserves the right to cancel, terminate or modify the Invite if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

8.2. Host and Talenthouse reserve the right to make changes in the rules of the Invite, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of Host or Talenthouse, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, Talenthouse and Host reserve the right, but not the obligation, to cancel or modify the Invite and shall not be required to award a substitute prize.

8.3. Failure to comply with these Rules may result in a contestants disqualification at Hosts or Talenthouses discretion.

8.4. Participants Entry shall not violate any laws whatsoever. This includes, but is not limited to, laws related to or governing intellectual property, patents, trademark, copyright, decency, obscenity, defamation, libel, disparagement, misrepresentation, privacy, equality, non-discrimination, and drugs or firearms. Participants Entry shall also not be pornographic, profane or materially dangerous in any respect. Participant shall indemnify Host and/or Talenthouse to the fullest extent of the law (including attorneys fees and costs) for the breach of any law

8.5. Host and Talenthouse are not responsible for typographical or other errors in the printing, the offering or the administration of the Invite, or in the announcement of a prize.

What is a Creative Invite? Established and respected artists launch Creative Invites (CI's) through Talenthouse to find and support new talent. An CI challenges our artistic community to submit ideas or concepts for a new, creative and typically collaborative artistic endeavour that is sponsored by our established artists. CI's are as diverse as the Talenthouse community itself and span everything from recording new tracks with well known musicians, to designing new fashion lines for renowned designers, to auditioning for film or television projects.

How do I participate in an Creative Invite? All artists are invited to peruse our CI page to find projects that appeal to them. When you find an CI that you want to submit your work for, click on that specific CI page. From there, simply click 'Submit' and follow the instructions.

Who is eligible to participate? Anyone. If you are a member of the Talenthouse community, you are eligible to submit your work to any CI.

How is the winner selected? The Talenthouse community votes for their favorite submissions to any particular CI. The finalists are those who receive the highest number of votes. Typically, the artists who hosted the CI will select the winning artist from these finalists. In other instances, the hosting artist may look beyond these finalists to the entire pool of submitted work to find the winner.

How many artists enter? The number of participants for any given CI varies and depends on the interest of the project in the community. There is no maximum or minimum number of entries for an CI.

Is there always a winner? Typically, there will be a winner for each CI. However, if none of the submissions meet the hosting artist's expectations or project vision, no winner will be selected.

How many times can I enter? You can only submit your work to a particular CI one time. There is no limit to the number of CI's you can participate in.

Will I get paid if I win? Talenthouse does not provide any monetary compensation to CI winners. If the project has any financial component, the terms of that arrangement will be negotiated and agreed upon by and between the hosting artist and the CI winner.

What will I get if I don't win? All CI submissions are available for viewing by the entire Talenthouse community. Because the Talenthouse community consists not only of undiscovered talent but also of industry leaders and established artists, each submission grants you the unique opportunity of global exposure for your work and talent.

Do you own the intellectual property rights to my artwork? Talenthouse's mission is to liberate all artists. Thus, Talenthouse does not retain any ownership rights to your artwork except a very limited right to use certain materials on its website and in its marketing documentation (see, the Terms of Use). As part of the Creative Invite process, the host of the Creative Invite may request additional ownership rights in your artwork as a pre-requisite to winning the Creative Invite. The host may also seek to work with you outside of the Creative Invite process. In any event, the rules for each Creative Invite are different and you should read them carefully before participating. The property rights a host obtains from the winner are set forth in the rules.

How long will Talenthouse publish my submission? Submissions become part of the project and as such will remain on your profile for as long as you maintain one. Should you delete your profile, Talenthouse will continue to publish your submissions in connection with the CI for up to twelve months.

After the CI is over, will the Talenthouse community still be able to view my work? Yes. Your submitted work will be viewable on your profile and also, should Talenthouse choose to use it, could be viewed on other locations on the Talenthouse site.

Can I launch my own CI, even if I'm not an established artist? Anyone and everyone can suggest an idea for an CI. Talenthouse will review your ideas. If your suggested CI is in tune with Talenthouse's mission and vision, we will publish it on the site.

How do I launch my own CI? Presently our website has a 'Suggest' button for CI's. Clicking on this button will allow you to suggest an idea or concept for a CI. Once submitted, Talenthouse will review your ideas. If your suggested CI is in tune with Talenthouse's mission and vision, we will publish it on the site. Additionally, we are developing an automated feature whereby all artists will be able to submit and sponsor their own CI.
